American Bar Association Criticizes Trump's Unlawful Government Restructuring and Urges Courts to Uphold Rule of Law


The ABA demands adherence to legal processes as Trump administration reshapes federal government

The American Bar Association (ABA) has issued a scathing statement regarding President Donald Trump's recent actions in the early days of his second administration, condemning the chaos and violations of the rule of law. The ABA, a nonpartisan organization that has been responsible for maintaining academic and ethical standards for the legal profession since 1878, emphasized the critical importance of adhering to the legal framework when making significant changes to the government.

In a statement released on February 11, 2025, ABA President William R. Bay urged the courts and legal professionals to act as a bulwark against the administration’s attempts to undermine fundamental legal principles. Bay began by acknowledging that change is a natural part of a new administration, but stressed that such change must take place within the bounds of the law, respecting the rights of individuals and the work they have committed to.

Since taking office on January 20, 2025, Trump has issued numerous executive orders aiming to radically reshape the federal government. These orders have included controversial moves to dismantle established agencies, such as the United States Agency for International Development (USAID), an agency founded by Congress. Bay specifically criticized these actions, noting that while they may appeal to a limited group, they have proven to be a chaotic and disruptive force. The ABA president called on Trump’s administration to respect the principles of democracy and the three coequal branches of government.

Bay also took aim at the administration's sweeping efforts to alter long-standing policies, particularly those related to birthright citizenship. Citing a recent federal court ruling, Bay highlighted U.S. District Judge John Coughenour’s decision, which rejected the administration's attempt to circumvent the 14th Amendment, which guarantees birthright citizenship. The judge remarked that the Trump administration had treated the rule of law as something to be ignored or navigated around. Bay commended Judge Coughenour for his unwavering commitment to upholding the law, emphasizing that the rule of law should be a “bright beacon” for the nation.

The ABA also addressed the mounting legal challenges facing the Trump administration. Within the first three weeks of his presidency, more than a dozen lawsuits have been filed against Trump’s actions. These lawsuits have raised concerns over issues such as federal fund distribution, which has created confusion and turmoil within federal agencies that employ millions of workers across the United States. Bay expressed concern that these legal battles, as well as the administration’s disregard for established legal processes, were eroding the trust that Americans place in their government.

In a bold statement, Vice President JD Vance suggested that the judicial actions against Trump’s policies were in violation of presidential powers. House Speaker Mike Johnson echoed this sentiment, urging the courts to step back and allow the administration to carry out its planned changes without judicial interference. The ABA’s president, however, made it clear that no government, regardless of political affiliation, should operate above the law.

Bay concluded by calling on lawmakers to step up and demand that the government adhere to legal procedures and processes. He urged politicians and legal professionals alike to stand firm in their commitment to the rule of law, emphasizing that the legal framework should not be disregarded, no matter the efficiency or appeal of a policy. The ABA president made it clear that this issue was not partisan; it was about ensuring that the legal processes that maintain order in society are respected and followed.
